1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
2. The Service Provider
The Service is operated and provided by Kick Turn Solutions LLC, a Colorado limited liability company, doing business as "Snowball" ("Company," "we," "us," or "our"). "Snowball" is a trade name of Kick Turn Solutions LLC registered with the Colorado Secretary of State on June 13, 2026.
3. Eligibility
You must be at least 13 years of age to access or use the Service. By using the Service, you represent and warrant that you (a) are at least 13 years old; (b) if you are under 18, have obtained the consent of a parent or legal guardian as described below; (c) have the legal capacity to enter into these Terms (or have such consent); (d) are not prohibited from using the Service under the laws of any applicable jurisdiction; and (e) will use the Service in compliance with these Terms and all applicable laws.
Minors and parental consent. If you are under 18 years of age (or the age of majority in your jurisdiction), you may use the Service only with the consent and supervision of a parent or legal guardian who has read and agrees to be bound by these Terms and who accepts responsibility for your use of the Service. By using the Service, you represent that such consent has been obtained. We may request verification of parental or guardian consent and may suspend or terminate any profile for which we cannot reasonably verify it. We do not knowingly permit children under 13 to use the Service.
4. Profiles and Registration
If the Service allows you to create a profile, you agree to provide accurate and complete information and to keep it current. You are responsible for safeguarding your login credentials and for all activity that occurs under your profile. Notify us promptly of any unauthorized use. We may suspend or terminate profiles that contain false information or are used in violation of these Terms.
5. Acceptable Use and Prohibited Conduct
You are responsible for your conduct and your content. You agree that you will not use the Service to:
- violate any applicable law, regulation, or third-party right;
- plan, organize, promote, facilitate, fund, or carry out violence, terrorism, property destruction, or any other unlawful act;
- threaten, harass, bully, stalk, defame, or intimidate any person;
- incite or encourage others to commit unlawful or violent acts;
- publish or distribute another person's private, personal, or identifying information without consent ("doxxing");
- post or transmit content that is unlawful, obscene, hateful, deceptive, or that infringes intellectual-property or privacy rights;
- impersonate any person or entity or misrepresent your affiliation with any person or entity;
- upload viruses or malicious code, or otherwise interfere with, disrupt, or overburden the Service;
- access the Service through automated means (including scraping or bots) except as we expressly permit, or collect or harvest other users' information;
- send spam, chain messages, or unsolicited communications, or engage in fraud.
We may, but are not obligated to, monitor use of the Service. We reserve the right (but assume no obligation) to remove or restrict any content and to suspend or terminate any profile that we believe, in our sole discretion, violates these Terms or applicable law. We may cooperate with law enforcement and disclose information where we believe in good faith it is necessary to comply with the law, protect the safety of any person, or address unlawful activity, consistent with our Privacy Policy and applicable law.
6. User Content
"User Content" means any content you submit, post, or transmit through the Service. You retain ownership of your User Content. You grant the Company a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify (for formatting), display, and distribute your User Content solely to operate, provide, and improve the Service.
You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms, any law, or any third-party right. We have no obligation to monitor User Content but may review and remove it at our discretion. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.
7. Real-World Events; Assumption of Risk
The Service is a neutral tool that helps users communicate and coordinate. The Company does not organize, sponsor, lead, supervise, control, or participate in any rally, gathering, cleanup, volunteer activity, mobilization, demonstration, or other event arranged, promoted, or coordinated through the Service (each, an "Event"), and is not a party to any arrangement between users.
You acknowledge that participation in or organization of Events carries inherent risks. To the fullest extent permitted by law, you assume all risks associated with attending, organizing, or relying on any Event, and you release the Company and its affiliates, officers, employees, and agents from any claims, liabilities, or damages arising out of or relating to any Event or to the conduct of any user or third party.
8. Political Activity, Legal Compliance, and No Endorsement
The Service may be used to support civic and political activity. The Company is a neutral platform and does not endorse, sponsor, or take positions on any candidate, political party, ballot measure, cause, organization, or movement. Any views expressed through the Service are those of users, not the Company.
You are solely responsible for ensuring that your use of the Service and your Events comply with all applicable laws, including, where relevant, permit and public-assembly requirements and election, campaign-finance, voter-registration, and lobbying laws. The Service does not provide legal advice.
9. Privacy
Your use of the Service is subject to our Privacy Policy (snowball.fast/privacy), which is incorporated into these Terms by reference. The Service may collect your email address and possibly zipcode-level location data. Our Privacy Policy describes what we collect, how we use it, and the choices available to you. Do not use the Service if you do not agree with our Privacy Policy.
10. Third-Party Services and Links
The Service may contain links to or integrations with third-party websites, applications, or services that we do not control. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their terms, not ours.
11. Intellectual Property; License to You
The Service, including its software, design, text, graphics, and the "Snowball" name, logos, and other marks, is owned by the Company or its licensors and is protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purpose. No rights are granted except as expressly stated in these Terms.
12. Copyright and DMCA Policy
We respect intellectual-property rights and expect users to do the same. If you believe content on the Service infringes your copyright, you may send a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notice must include the information required by 17 U.S.C. § 512(c)(3). We will respond to valid notices, may remove or disable access to infringing content, and may terminate the profiles of repeat infringers in appropriate circumstances.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Upon termination, your license to use the Service ends. Provisions that by their nature should survive termination (including Sections 5–18) will survive.

17. Governing Law, Venue, and Dispute Resolution
These Terms and any action related to them are governed by the laws of the State of Colorado, without regard to its conflict-of-laws provisions.
Except where prohibited, you and the Company agree that the state and federal courts located in Boulder County, Colorado will have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts.

If the changes are material, we will provide reasonable notice (for example, through the Service or by email). Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes.
19. General
These Terms, together with the Privacy Policy, are the entire agreement between you and the Company regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. Section headings are for convenience only.
